The line numbering of Mr. DuBois' testimony can simply be treated as transcript corrections. Items (2) and (3) are essentially information request responses. At the request of CPB, Mr. Van Tassel's submission has been marked Exhibit 168 for identification. Objections to the admission of this exhibit should be submitted no later than close of business Tuesday, February 3. Mr. Haering's further statement follows, the ESCO information is in the attached spreadsheet and the DuBois testimony is also attached: As part of my testimony during the rate case hearings on January 15, 2009 I was asked by Mr. Glasser to report the status of Central Hudson’s 2008 year end performance regarding gas leaks. I indicated that we had discovered 626 leaks and repaired 381 leaks during 2008 and additionally that we had a year-end backlog of 466 leaks. In response to DPS IR 731 we had provided our 2008 year-end Gas Safety Performance Measurement Data which indicated that we had discovered 562 leaks, repaired 473 leaks and had a year end backlog of 466 leaks. The data provided to staff in response to IR 731 are accurate and correct based on the PSC reporting requirement that reported data exclude third party damages for leaks discovered and leaks repaired. The 626 leaks discovered that I indicated on the stand includes those associated with third party damage. The leaks discovered during 2008 excluding third party damages are 562. The 381 leaks repaired represented the original number of planned leak repairs excluding those associated with third party damages that Central Hudson had forecasted to complete during 2008. The actual number of leaks repaired in 2008 excluding third party damages was 473 leaks.
